Terms of Service
Last updated 2026-10-26
Draft under legal review. It may change before Feeds opens to the public.
These terms govern your use of Feeds (the “Service”), operated by TheWiseMonkey LLC, a Wyoming limited liability company (“we”, “us”). By creating an account or using the API, you accept them on behalf of yourself and the organization you represent.
1. The Service
Feeds checks public posts of X and LinkedIn accounts you choose and delivers them to you by API, webhook, and RSS. We obtain the posts from third-party data providers. We are not affiliated with, endorsed by, or sponsored by X Corp. or LinkedIn Corporation.
We may change the Service, add or remove features, and add or remove platforms. If a platform stops being available to us, your trackers on it stop, and your unused credits stay usable on the rest of the Service.
2. Accounts and API keys
You must give accurate information and keep your password and API keys secret. You are responsible for everything done with your account and keys. Tell us at once at [email protected] if you think a key or your account was compromised; revoke the key in the console.
You must be at least 18 years old and able to enter into a contract.
3. Credits, plans, and payment
- Credits. Usage is measured in credits. The credit cost of each operation is published on the pricing page. We may change these costs with at least 30 days’ notice by email and on the changelog; changes never alter the credits you already have.
- Plans. Plans renew monthly until you cancel. Each paid period adds the plan’s credits to your balance. You can cancel at any time in the billing portal; the plan ends at the end of the paid period.
- Extra credits require an active plan.
- No expiry, no cash value. Credits do not expire while your account exists. They have no cash value, cannot be transferred or resold, and are not refunded except as the refund policy or the law requires.
- Payment. Stripe processes payments. Prices exclude taxes; we add the taxes the law requires. If a payment fails, we may pause your trackers until it is resolved.
- Disputes. If you dispute a charge with your bank, we may hold your account until the dispute closes, and remove the credits of a charge that was returned to you.
4. Acceptable use
You must follow the Acceptable Use Policy. We may suspend or end access that breaks it, with or without notice when the breach is serious.
5. Your use of the data
The posts the Service delivers are public content authored by third parties. They remain the property of their authors and are subject to the terms of the platforms they come from and to the law, including data protection law. You are responsible for having a lawful basis for your use of the data, for honoring the rights of the people it concerns, and for any obligations you owe as a controller of personal data.
We grant you a non-exclusive, non-transferable right to use the data the Service delivers for your internal purposes and in your own products, but not to resell or redistribute it as a data feed or as a competing service.
6. Our rights
The Service, its software, documentation, and brand belong to us. You may not copy, reverse engineer, or resell the Service, or use it to build a competing service.
7. Availability and support
We provide the Service “as is” and “as available”, without a service-level agreement. Third-party providers can be slow, change, or stop. Failed checks are not charged. Support is by email at [email protected], on a best-effort basis.
8. Disclaimers
To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the data is complete, accurate, or timely.
9. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months before the claim.
10. Indemnity
You will defend and indemnify us against third-party claims that arise from your use of the data or from your breach of these terms or of the law.
11. Termination
You can close your account at any time by writing to [email protected]. We can end the Service for you for a material breach, or for any reason with 30 days’ notice; in the second case we refund the price of your unused purchased credits. Sections 3 (disputes), 5, 6, and 8 to 12 survive termination.
12. General
Wyoming law governs these terms, without regard to its conflict-of-law rules. Courts in Wyoming have exclusive jurisdiction, except that either party may seek urgent relief in any competent court. If a provision is unenforceable, the rest remains in force. We may update these terms; we will give at least 30 days’ notice of material changes by email. These terms, the policies they link to, and your order form, if any, are the entire agreement.
